Product: Means any goods and/or services offered for sale by the Seller on the Website.
3. Subject and Scope of the Contract
3.1 The subject matter of the User Agreement is the determination of the Services offered on the Website, the terms of utilization of these Services and the rights and obligations of the parties.
3.2 The scope of the User Agreement is the User Agreement and its annexes and all statements such as all warnings, writings and explanations made by Nordist regarding the use, membership and Services on the Website.

5. Rights and Obligations

Nordist shall not have any direct or indirect liability, whether direct or indirect, for any damages incurred or to be incurred by the Users and/or third parties due to all negligence and defects of the Users in matters such as the security, storage, keeping away from the knowledge of third parties, and use of the means of access to the system.
5.1.4 Users accept, declare and undertake that the information and content provided by them within the Website are accurate and lawful. Nordist is not obliged and responsible for investigating the accuracy of the information and content transmitted to Nordist by the Users or uploaded, modified or provided by them through the Website, undertaking and guaranteeing that this information and content is safe, accurate and lawful, and cannot be held liable for any damages arising from the incorrectness or inaccuracy of such information and content.
5.1.5 The User may not transfer its rights and obligations under the User Agreement, in whole or in part, to any third party without Nordist’s written consent.
5.1.6 Those who benefit from the Services offered by Nordist and those who use the Website may only perform transactions on the Website for lawful purposes. The legal and criminal responsibility for every transaction and action of the Users within the Website belongs to them. Each User accepts, declares and undertakes that he/she will not reproduce, copy, distribute, process the pictures, texts, visual and audio images, video clips, files, databases, catalogs and lists contained on the Website in a way that violates the real or personal rights or assets of Nordist and/or another third party, and that he/she will not compete directly and/or indirectly with Nordist either directly and/or indirectly with these actions or in other ways. 5.1.8 Users accept, declare and undertake that they will not make transactions to transfer money between their own memberships and memberships of their relatives on the Website and that they will not engage in behaviors that will manipulate the functioning of the Website, otherwise they will compensate for any damages incurred by Nordist.
5.2 Nordist’s Rights and Obligations

5.2.4 Nordist may perform the necessary content and/or message scanning in order to detect messages and/or contents that take place between Users through the Website and that are contrary to the operation of the Website and/or the User Agreement and/or the general rules of the Website and/or the general rules of morality and that cannot be accepted by Nordist, and may remove the messages and/or contents it detects from access at any time and in any way; it may terminate the user’s membership temporarily or permanently without any notice.

6. Confidentiality Provisions
Nordist may use information about users in accordance with the regulations in the Privacy Provisions on this Website. Nordist will not use confidential information of Users contrary to the User Agreement and Privacy Provisions.
7. Intellectual Property Rights

8. Contract Amendments

9. Force Majeure
In all cases deemed to be legally force majeure, Nordist shall not be liable for late or incomplete performance or non-performance of any of its obligations under this Agreement. In cases of force majeure; delay, incomplete performance or non-performance or default shall not be deemed, nor shall the User be entitled to claim any compensation under any name from Nordist for these situations. The term force majeure shall be interpreted as unavoidable events beyond Nordist’s reasonable control and unavoidable events that cannot be prevented despite due diligence, including but not limited to natural disasters, riots, war, strikes, cyber attacks, communication problems, infrastructure and internet failures, cyber attacks, system improvement or renewal works and failures that may occur for this reason, power outages and bad weather conditions.
10. Applicable Law and Competent Court
Turkish Law shall apply to the implementation and interpretation of this User Agreement and to the management of legal relations arising under its provisions. Istanbul Courts and Enforcement Offices are authorized to settle any disputes arising or that may arise from this User Agreement.
